My Artwork was used without my permission, advice needed.

Hey everyone, Same old story you know the drill,

    My artwork... http://.com/images/view/10737

Blatant misuse of my copyright for profit ... http://140blood.com

Any one got any advice on what I should do?

damn. This has been happening waay too often lately. I'm assuming all the art assets are stolen. First off contact any artist that have been ripped off as you can. contact 140blood and ask them to stop or give you all of their money. If that doesn't work figure out what state they're from, then contact a pro-bono copyright lawyer from that state and see what the next step is.

Send them an email, explain the problem and see what they say. If they don't want to play ball contact Twitter and tell them that these people have stolen your work and are using it for profit. Hopefully you won't need to remind Twitter that by supporting that app they are operating against the law. You might also try 140blood's ISP and try to get them shut down, as (c) infringement is always against TOC.

I doubt permission was given for the other artworks either (they're all familiar but I can't think whose they are). If you find out you might want to contact them.

First one didn't come up with anything, maybe someone else has seen their work around here. Dunno, really irks me this type of stuff.

    Good Luck!

I think a typical response would be an ultimatum cease and desist letter, or demand for compensation. Give them no more then a few days to respond before you get your lawyer involved. You don't want them to have time to think about it. What's yours is yours.

Be sure to take screenshots as evidence or collect proof BEFORE you contact them. Or they'll just take it down temporarily and play dumb and go "What stolen art I don't see anything"

Check up on twitter's tos policy.

Ah yes. The fabled MUD industry that skyrocketed on facebook and other social sites. They either make tone of money, or epic fail. And i chuckled as soon as i saw who it was..
These foos are not around facebook anymore (even though they had a pretty big player base) because like many, they just wanted to get their regurgitated MUD formula out there as fast as possible.
That's what happens when a buncha dorks from computer sciences get together and realise they need artists and artists cost money.

I'd demand a cut before i demand cease and desist. Lotsa people still play this shit and view the art so if they agree to give you a cut it's a win for you.

I sent him a Cease and Desist. He sent me any email back...

Some wicked vampire art there. I'll be happy to take it down at your request,
but I don't think it would matter as this game flopped spectacularly.
You can verify the stats of 140blood.com at compete.com for yourself:
    http://siteanalytics.compete.com/140blood.com/

Still, I can offer to pay $10 for it. Just give me your paypal address and I'll send it over.
If not, I'll just take the image down.
Wow, a whole 10 dollars! The phrase "insultingly lowball bid" comes to mind. He didn't even apologize, what a scum-ball.

    My repy:

Your attitude is truly unexpected and disconcerting. Not only did you not apologize for stealing my work, but when caught with the crime you then offer me $10, an amount so low it's insulting.

Apparently, you have mistaken me for someone who doesn't know the value of my work or the rights I am afforded under copyright law. I truly thought the first email would have made clear my knowledge and seriousness in this matter.

I will repeat: The consequences of your actions may result in civil fines, including but not limited to attorney fees, penalties and prosecution by the U.S. Attorney's office for willful violation of Copyright Laws. You are to immediately inform myself once you have complied with the Cease and Desist request. Understand that obeying this request still does not exculpate you, and you can still be subject to future legal action from myself at my own discretion. I hope I have made myself clear.

That is a sensible response, hopefully they will realise what the real issues are here and learn from them (at least). Unfortunately with the sheer scale and stretch of the Internet, there's a lot of instances like this happening due to either blatant 'theft' as such, or just individuals not familiar with intellectual property guidelines.

Double whammy then. Not only was your work stolen it was used on a game that was a total flop by a developer who, apparently, is a bit of a spammer. Apparently his apps were banned from Facebook

No admission that he did anything wrong, or that (I'm sure) ALL of the art was stolen.

He took it down and replaced it with another stolen image. Thanks to tineye.com and Deiviant Art it took me all of about 5 minutes to find the artist of the new stolen image. This artist has been informed of the situation and it looks like this 140blood guy is going to get his second Cease and Desist in the past 48 hours. Some people just don't learn.

these cases make me glad that my art still is not very good...but as i am improving rapidly, i am kinda worried that something like this might happen to me in hithe future >_<

question: i am from europe, but if someone from amerika steals my art like this, does anyone have any idea how i should deal with this? i am not sure if a lawyer or anything could do much for me because there are different rules in each country
