Someone's Selling my work on Ebay illegaly!!

So I just got an email from someone who linked me to an ebay seller printing images on "Silk Cloth" which are obviously not his. There are a list of images you can rifle through at the bottom of the page so check out if something belongs to you.

    Link

This is pretty retarded....God knows how much this guy has made off other people's work.

Each item listing has a Report tool... Send'em in...

    He has 3726 feedbacks. 3726 x $9/poster is about $33,500

He's also using iStock vectors and selling them. I'm pretty sure he didn't buy the license necessary to do that sort of thing.

Ha.. someone's been leaving negative feedback.. not the most helpful with just "boo".. but amusing none the less.

I see they are out of Hongkong and now I am less surprised.

    Ass.

As for the stolen artwork, I'm not sure what you could do, short of reporting every poster. Maybe there is a way of contacting ebay?

Oh come on... that was a halfway amusing joke about the reality of things. It is not uncommon or unknown that China has had a long term disagreement over intellectual property rights with the rest of the world. So an ebay company selling silk prints of other peoples digital artwork is not outside the realm of humor.

I'm sure his comment has absolutely nothing to do with racism. China is well known for being a prolific center for IP theft and piracy on a large scale, which is not enforced at all. Many western brands, magazines, clothes, software, books, artworks, games, movies, etc are all copied and openly resold on Chinese store shelves with zero regard to copyright law.

Not to mention this just came out today:

I assumed this was Chinese. It's not a racial assumption, it's a legal and cultural one. China just doesn't play by the same copyright rules as the Western world. I don't know that making that association is any more racial than associating the Swiss with neutrality... or something.

They have blizzard stuff... wonder if blizzard's got any power over them just because of sheer size. And do I see star wars and mario? One of these big fishes has to be able to get the guy to at least stop, or banned from ebay...

    this thread is hilarious!

No offense man but why are they selling your old fan art? If they're going to rip somebody off why not the actual concept art from L4D? Don't get me wrong I think your sketchbook is pretty good, but that piece is below your current standards.

His logic must be like this math equasion.
    steal art+post on ebay=$$$$$$$$$$

If it's any consolation you can probably put this on your resum`e and that thief is going to die in a gutter.

Been trying to get in to ebay for the past 8 hrs and I cant seem to login.......anyways

Raoul Duke I was wondering the same thing but I came to the obvious conclusion that since this piece is up on DA and has 14,000 views it must have turned up on some search engine....

Hopefully I'll be able to get on soon. Thanks everyone

Hahahah, i imagined some creepy Chinese guy in a tight corset and fishnet tights, leaning over a table of stolen artwork and saying, "I'm sure we can come to some kind of...arrangement...Sir~..."

Cultural, economic and legal differences make places such as China popular spots for copyright infringement and piracy. And don't forget the geographical distance. It all makes it difficult if not impossible to go after them. Even if it's illegal there, it's often ignored. Though China is not the only country to do this (My friend can still easily buy pirated software in the large malls of Bangkok thought it's illegal) it's become the most notorious.

Anyways back to the problem at hand I don't think I should accept any money...If I do that means i condone what he's doing doesn't it?

I also apparently have to jump through hoops for ebay to acknowledge my ownership of the contested artwork. Typical....

On a lighter note it would be fun to see how much they'd b willing to pay up hehe!!

Potential business partner and access to some printing services should you have a possible entrepreneurial idea of your own.

Yeah you should go for the printing service, because they would make great business partners. They seem to be trustworthy and ethical.

    Woah... Calm the cinders!

I'm surprised such a comment coming from a Scotsman, ne?

    - Just kidding. I'm in Scotland too by the way.

Since we're being picky, I thought I'd help you out by letting you know that its is never apostraphe'd when indicating ownership. Its alone indicates ownership.

    eg.
    "Its feathers looked damp."
    not
"It's feathers looked damp." and not "Its' feathers looked damp."

An apostraphe'd its is a contraction of it has and it is.
Its' doesn't exist, as far as I know. ~ Unless you're speaking with an accent; ie. Its'a Marioh!

Going back to the OP. If it were me, I'd strike a deal. Charge them royalties per each item sold and, in the future, offer them more artwork to sell.

Of course, since they're within China, you'll have to expect the unexpected. But you can always reign down the hammers upon them at any time you want.

I would seriously avoid royalties. I'd ask for about 2 grand under the condition they stop. If they don't get in touch with valve. I'm sure they'd help. These prints are tarnishing both valves brand and your value as an artist.

How much is eBay's cut then subtract 60% before Ebay takes and their cut much much less and tell them next time it going to be 100% if they try to use your work with asking in writing and paying you the fees you want for your art.. Get your work info and dates and get ebay on it also tell them people are asking you if you want a cut .. heck if they made just over $33K on just small amount but ebay can be slow but they will act as soon as you give then the right info.

what is Ebay's cut? has be 20 to 40% of what they make before profits plus if they are using paypal there is another cut of the what they take in ...make them feel the burn get as much before the cut.. heck if ebay sides with you their out 100% and they could lose their accounts and for them be on ebay. but do note they asked which account too so like many of these people that have like more than one site. I would not really trust they will pay but they do know that if they do not try to deal with you it will burn them for some of the accounts ..ask l ebay to go full IP detection on them to ID their account as I do remember right you are not suppose to be selling under more then one account .. if the are using paypal alert them to they will flag and holdall they funds on copy right volition i think too I know what it like to have art taken and profited off of it sucks but getting them bust is really sweet.
