This may be a little too technical, but the head looks like a jack-o-lantern. As these are generally made of gourds, and gourds are a food source, this guy will actually be a crow attracter. I would also recommend a reference for the crows. Other than that, it doesn't look too bad, though I prefer the thick-lined version and there's something wrong with the composition that I can't identify (having to do with the position of the scythe).
Edit: Oh, that pattern on the hat: it flattens it out completely (in a bad way).

just a thought, maybe you have the scythe resting on the arms. to almost suggest that he will come alive at night. it looks abit too obvious just being in his hand.

I think the scythe would look better if it went behind his legs.

The inked version seem to lose the line weight variations. As for the drawing itself, I'd suggest to make the head bend down more, and make the arms more soft and drop down in a more natural fashion. Right now it looks a bit stiff, as if it has some hard grass inside.
And I see his tie floating toward the left side, you may want to make the dry grass or whatever the stuffings are, flying toward the left side too, just so they'd have the same wind.

the penciled stage i enjoy more then inked, but u got some cool colors going on <3
