Go to http://www.wacom.com, download the latest drivers for OS X, and install those instead.

well, that advice was my best bet but.... after installing the latest driver... and use the tablet with all the fancy shmancy pen prefs... I shut down the comp for the night, and low and behold in the morning, at plug in the wacom pan works as a mouse... so now the tablet still works... but when I open up the software to adjust all the prefs, none work, the tilt mode is motion less, the draw here has no lineweight variation, and the eraser doesn't work, I don't want to have to reinstall the driver software -everytime- I draw with my tablet, any ideas?????

Sounds like a problem with your system to me. I've run my tablet on OS 9.2 through Jaguar through Panther with many variations on the drivers, and have had no problems like you describe.
If you have any other peripherals, turn them all off AND unplug them. If you are using a USB hub, unplug it and go straight into the Mac. If this helps, it's a driver conflict, and that's a whole 'nutha world.
If your prefs aren't sticking or changing when you alter them, try repairing your disk permissions...ideally, boot off a 2nd hard drive and do a full disk utility run on your internal HD (or the ol' fsck -y in the Terminal).
