when i'm using photoshop, i am unable to use my tablet as it paints before i touch it to the surface, any way to remedy this?

Sounds like either your pen is defective, like the tip is constantly being pressed, or you need to uninstall the tablet driver and reinstall it. I use an Intuos3 and I can hover over the tablet and press the tip of the pen with my finger and the pen/tablet thinks I'm touching the actual tablet surface.
The pen sends all pressure and location data. All the tablet does radiate an electro magnetic field to the pen and take in location, like an energy and tracking surface. From what I understand your pen is the actual decision maker in pressure, tilt and location, not the tablet surface. So if you are hovering and still getting paint on the canvas then your pen tip thinks it's being depressed. Make sure the nib isn't in there to tight. It should only be resting in there upon install and it will seat itself when you start to work. If your nib has a burr on it or if it is bent it could be stuck in the depressed state. Try another pen if you can get one. No doubt the issue starts there I bet.
